Collins API Terms and Conditions

These terms and conditions (the “Terms of Use”) are the terms on which HarperCollins’ language application programming interfaces (the “HCP APIs”) is made available to you (“You”/”Your”). By accessing this Site You agree to be bound by these Terms.

This website www.collinsdictionary.com/api (the “Site”) is owned and operated by HarperCollins Publishers Limited a company registered in Scotland under registration number 27389 and our registered address is Westerhill Road, Bishopsbriggs, Glasgow, G64 2QT (“HCP/HarperCollins/ We”/ “Us”/”Our”).

By registering for a HCP API you agree to be bound by, and to use the HCP APIs in accordance with these Terms of Use and the Privacy Policy located at Terms and Conditions and any additional terms and conditions that may apply to the HCP API as we may notify you of from time to time.
HarperCollins reserve the right to change these Terms of Use or to impose new conditions on your use of the HCP APIs from time to time, in which case we will post the revised Terms of Use on this website and update the “Last Updated” date to reflect the date of the changes. It is therefore important that you review this page often to ensure that you are aware of all changes. By continuing to use the HCP APIs after we post any such changes, you accept the Terms of Use, as modified.

We also reserve the right to deny access to the HCP APIs and/or to revoke the rights to use such HCP APIs granted hereunder, to anyone who violates these Terms of Use.

HCP APIs Registration Process

In order to use the HCP APIs, you must apply for a separate API key for each use of a HCP APIs (e.g., on a website, in an application, etc.). In order to apply for an API key, you will be asked to register with us on the form provided here to be sent to apicollinsdicty@harpercollins.co.uk and such registration may require you to provide personally identifiable information such as your name and email address. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration form. You agree not to use any script, software, or other automated methods of applying for or creating or attempting to create multiple API keys. If we have reasonable grounds to suspect that your registration contains information that is untrue, inaccurate, or incomplete, or your form otherwise does not comply with these Terms of Use, we have the right to suspend or terminate your account and refuse you any and all current or future use of, or access to, the HCP APIs (or any portion thereof). Our use of any personally identifiable information you provide to us as part of the registration process is governed by the terms of our Privacy Policy.

Rights and Restrictions

The HCP APIs are licensed to you solely for either for (i) your personal, non-commercial use; or (ii) under the terms of a commercial licence, and your use of the HCP APIs is at all times subject to these Terms of Use, including the attribution requirements set forth above. You must incorporate the applicable API key into any application or service that you create or develop that incorporates a HCP API and such API key must accompany all information requests coming from your application or service. Each and any use by you of the materials, content or data made available through an HCP API must be made through information requests to an HCP API through the applicable API key and you may not use the API key to download, store or cache any HCP materials, content or data in any offline or online storage that would result in such information requests not being made. You must apply for separate API keys for each application or service in which you use or incorporate a HCP API. Such application must comply with requirements of the HCP API Registration Process, which are explained in more detail above. The API key(s) you receive are unique to you, and may not be transferred or assigned to any other person or entity without our consent.

The HCP APIs, and all the information, materials, content and data in and all the output of the HCP APIs, are the property of HCP and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by HCP. Subject to these Terms of Use, you may retain rights in and to any software or content developed by you prior to or independent of the HCP APIs and that does not incorporate the HCP APIs or any portion thereof.

You must abide by any request volumes that we, in our sole discretion, may place on the use of a HCP API. You may not use the HCP APIs in a manner that exceeds such request volume, constitutes excessive or abusive usage, or otherwise fails to comply or is inconsistent with any terms that HCP may impose on the use of a HCP API, in each case as determined by us, in our sole discretion.

You agree not to use the HCP APIs for any commercial purpose without a valid licence or in any product or service that competes with HCP or its products or services. For example, you agree not to sell any application or service built using a HCP API and you agree not to sell or charge a fee for any HCP materials, content or data that may be included in an application or service containing a HCP API unless the terms of your licence allow this use.
You may not use the HCP APIs, or the information, content, materials or data in or output of the HCP APIs, in a manner or in connection with a service that violates any laws or regulations, violates or infringes the rights of, or causes injury to, any person or entity or collects personal information from users of your service without appropriate notice and consent.
You agree not to sell, lease, share, transfer, or sublicense the HCP APIs, any API keys or access codes.

Attribution Requirements

All of your uses, applications and services that incorporate or use a HCP API must include the following Copyright line:

In addition, you must keep intact all copyright and other proprietary notices contained within the HCP APIs. You may not use the HCP API logo or the information, content, material, data in or output from a HCP API in a way that implies or suggests that HCP promotes, endorses or sponsors you, your application or service, any third party, or any content, product or service of you or any third party.

Support

You understand that we have no obligation to provide technical or other support for the HCP APIs. We do, however, reserve the right at all times, in our sole discretion, to offer support for the HCP APIs. If we elect to provide you with support for the HCP APIs, we may, in our sole discretion, change, suspend, discontinue or terminate such support and/or any aspect of such support at any time without notice or liability to you.

Fees

Non-Commercial Licence

HarperCollins will not charge you for non-commercial use of the HCP API. HCP reserves the right to, and may, in its sole discretion, decide, to charge fees for non-commercial use of, or access to, the HCP APIs or any portion thereof. If HCP decides to charge a fee for use of or access to the HCP APIs, such fees will be disclosed to you prior to HCP charging such fees to you.

Commercial Licence

If you wish to incorporate the HCP API into a commercial product you will need a commercial licence. The licence fees for a commercial licence can be found at Schedule 1 of this Agreement, you will be billed on a monthly basis and payment will be deducted from your account at the beginning of each month.

Payment of your commercial licence must be by BACS or Direct Debit.
You may cancel your commercial licence for the HCP API at any time by giving 28 days notice or as otherwise agreed. HarperCollins will not refund any money paid and if your cancellation notice period extends into a new month HarperCollins will deduct the full month’s licence fee from your account.

Security and Privacy

You must read Our Privacy Policy which contains important information about the use of Your personal data other information regarding Your privacy and Our security processes and policies.
We will co-operate with any law enforcement authorities or court order requesting or directing Us to disclose the identity of or locate anyone breaching any law or otherwise for the prevention or detection of crime or the apprehension or prosecution of offenders. There may be other circumstances in which We may be required by law to disclose information about You or Your use of the Website.

Modifications to, or Discontinuation of, the HCP APIs

We reserve the right at any time and from time to time to modify or discontinue (temporarily or permanently) the HCP APIs, any individual HCP API, or any portion thereof, without notice or liability to you. We also may impose limits on certain features and services or restrict your access to parts or all of the HCP APIs without notice or liability to you.
Suspension and Termination of Access

You agree that, in our sole discretion, we may suspend or terminate your API key(s), your account (or any part thereof) and/or your use of any HCP APIs, or any portion thereof, at any time, for any reason, without notice to you. You agree that we will not be liable to you or any third-party for any suspension or termination of your API key(s), account (or any part thereof) or use of any HCP APIs or any portion thereof. In the event that we suspend or terminate your access to and/or use of any API key(s), account or any HCP APIs, you will continue to be bound by the Terms of Use that were in effect as of the date of your suspension or termination.

Disclaimers

THE HCP APIs, AND ALL INFORMATION, MATERIALS, CONTENT, DATA AND OUTPUT OFFERED THROUGH OR DISPLAYED BY THE HCP APIs, AND ANY SUPPORT SERVICES THAT WE MAY OFFER, ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE HCP APIs OR ANY OF ITS FUNCTIONS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THE HCP APIs, THE API KEYS, THE INFORMATION, MATERIALS, CONTENT, DATA AND OUTPUT OFFERED THROUGH OR DISPLAYED BY THE HCP APIs, OR THE SERVERS THAT MAKE THE HCP APIs AVAILABLE, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE HCP APIs, OR INFORMATION, MATERIALS, CONTENT, DATA AND OUTPUT OFFERED THROUGH OR DISPLAYED BY THE HCP APIs OR ANY SUPPORT SERVICES THAT MAY BE PROVIDED, IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE.

You must provide and are solely responsible for all hardware and/or software necessary to access and use the HCP APIs. You assume the entire cost of and responsibility for any damage to, and all necessary maintenance, repair or correction of, that hardware and/or software.
The HCP APIs is provided for informational purposes only and is not intended for commercial use.

Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL WE OR OUR SUBSIDIARIES, PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE HCP APIs, INCLUDING ITS INFORMATION, MATERIALS, CONTENT, DATA OR OUTPUT, OR ANY SUPPORT SERVICES WE MAY PROVIDE, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY AND THE LIABILITY OF OUR SUBSIDIARIES, PARENT COMPANIES AND AFFILIATES, IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.) IF YOU ARE DISSATISFIED WITH THE HCP APIs, OR ANY INFORMATION, MATERIALS, CONTENT, DATA OR OUTPUT OF THE HCP APIs, OR WITH ANY OF THE HCP APIs TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE HCP APIs.

Indemnification

You agree to indemnify and hold harmless us, our affiliates, and each of our and their respective directors, officers, managers, employees, shareholders, agents, representatives and licensors, from and against any and all losses, expenses, damages and costs, including reasonable attorneys’ fees, that arise out of your use of the HCP APIs, violation of these Terms of Use by you or any other person using your account or your API key(s), or your violation of any rights of another. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this section. In such event, you agree to provide us with such cooperation as is reasonably requested by us.

Trade Marks

HARPERCOLLINS, COLLINS, COLLINS GEM, BANK OF ENGLISH COBUILD, and the ‘fireandwater logo’ are registered trade marks or trade marks of HarperCollins Publishers Ltd, and no users of this site are permitted to copy or reproduce these trade marks, use them in any product, or allow anyone else to do so for any reason, without the prior written consent of HarperCollins.

Business Transfers

In the event that HarperCollins is bought by another party or sells or otherwise disposes of part of its business we reserve the right to sell your information as part of this transfer and you agree to such transfer. If such an event does occur we will require that your data is used as per the terms of the privacy policy unless you are otherwise notified.

Notices

All correspondence sent by you to us must be sent to apicollinsdicty@harpercollins.co.uk. We may give respond to you at either the e-mail or postal address you provide to us when placing an order, or by any other method where you have provided us with contact details. Any correspondence to us must be sent to the correct address.

Applicable Law

This Site, including the content and information contained herein, shall be governed by the laws of England and the courts of England shall be the place of jurisdiction. As such, the laws of England shall govern the disclaimer, legal notices, terms and conditions.

Other

The section headings and subheadings contained in this agreement are included for convenience only, and shall not limit or otherwise affect the terms of the Terms of Use. Any construction or interpretation to be made of the Terms of Use shall not be construed against the drafter.

This agreement is personal to you and you may not assign it to anyone. If any provision of this agreement is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this agreement and will not affect the validity and enforceability of any remaining provisions. These Terms Use are not intended to benefit any third party, and do not create any third party beneficiaries. Accordingly, these Terms of Use may only be invoked or enforced by you or us.
